These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and BodyGood Health Inc. ("BodyGood," "we," "us," or "our") governing your access to and use of the website men.joinbodygood.com (the "Site") and all related services, products, and content.

BY ACCESSING OR USING THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

1. Eligibility

You must be at least 18 years of age and a resident of the United States to use our services. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is truthful and accurate.

2. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Telehealth Services

BodyGood facilitates access to licensed healthcare providers through telehealth technology. By using our telehealth services, you acknowledge and agree that:

  • Telehealth consultations are not a substitute for in-person medical examinations when clinically necessary
  • The prescribing clinician has final authority over treatment decisions
  • You will provide complete and accurate health information
  • Treatment outcomes may vary and are not guaranteed
  • In case of a medical emergency, you will call 911 or visit the nearest emergency room

4. Products and Prescriptions

All prescription products are subject to approval by a licensed healthcare provider. BodyGood does not guarantee that any prescription will be issued. Products are dispensed by licensed pharmacies and shipped in compliance with applicable laws. You agree not to share, transfer, or resell any prescription products.

5. Pricing and Payment

All prices are listed in U.S. Dollars. We reserve the right to change prices at any time without prior notice. Payment is due at the time of order. Subscription plans auto-renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account or by contacting support.

6. Shipping, Returns & Refunds

We offer free standard shipping on all orders. Prescription products cannot be returned due to health and safety regulations. If you experience an issue with your order, contact us and we will work to resolve it. Refund eligibility is determined on a case-by-case basis at our sole discretion.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, software, and design — is the property of BodyGood Health Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

8. Prohibited Conduct

You agree not to:

  • Provide false or misleading information in health questionnaires or account registration
  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Site's functionality
  • Use automated tools (bots, scrapers, etc.) to access the Site without permission
  • Resell, redistribute, or commercially exploit any products or content

9. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BODYGOOD DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BODYGOOD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO BODYGOOD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless BodyGood Health Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.

12. Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our services ("Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may seek injunctive or other equitable relief in court for matters relating to intellectual property or unauthorized access.

Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association ("AAA") then in effect. The arbitration shall be held in Broward County, Florida.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator shall have the authority to award the same damages and relief that a court could award.

CLASS ACTION WAIVER: You and BodyGood agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

JURY TRIAL WAIVER: By agreeing to arbitration, you and BodyGood each waive the right to a trial by jury.

If any portion of this arbitration provision is found to be unenforceable, the remaining portions shall remain in full force and effect.

13. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

For any matters not subject to arbitration, or to the extent arbitration is found unenforceable, you agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida. You waive any objection to jurisdiction or venue in such courts.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BodyGood regarding your use of the Site and supersede all prior agreements, representations, and understandings.

16. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any modification constitutes acceptance of the revised Terms.
